                            Judge Free to Rock On (Grades 6-8)
NEW YORK, New York (Achieve3000, September 20, 2010). New York Supreme Court Justice Matthew D'Emic is considering a monumental decision, one with far-reaching impact: Does Whippoorwill, the rock band he played in three decades ago, need a more modern name? Thus far, the most promising suggestions from his children and co-workers include Rock 'n' Robes and L.L. Cool Judge. The honorable D'Emic, 57, recently decided to reassemble the band after learning that he was not obligated to trade in his gavel to do so. A June 2010 opinion from New York's Committee on Judicial Ethics paved the way for the state's judges to moonlight as musicians. The ruling was good news for D'Emic and other judges who are considering supplementing their income. While state judges earn $136,700 annually, they haven't received a pay increase in 12 years.

Judge D'Emic is one of two New York Supreme Court judges who recently requested clarification from the state's ethics committee regarding whether it was proper to seek payment for work as a musician or artist. There are no rules banning judges from such pursuits. It was not clear, however, whether they were allowed to accept payment for such activities. A committee of 26 judges issued an opinion that judges in the state are free to play in bands for money or sell their artwork. There is one important condition: The activities must not interfere with the judges' day jobs.

"The judge who wishes to pursue part-time employment as a…musician may do so only occasionally, for a fee, for family, friends, neighbors, and others who are unlikely to appear in the judge's court," the committee said.

Cynthia Gray is the director of the Center for Judicial Ethics at the American Judicature Society. According to Gray, the opinion is not new. Other states have addressed the issue of judges moonlighting after court adjourns for the day, and arrived at similar conclusions. In Wisconsin and Massachusetts, advisory opinions said that judges were allowed to sell their artwork. In Illinois, a judge was granted permission to play violin in a wedding. Another judge was permitted to act in a play for a token payment of a few thousand dollars. (Additional payment was prohibited.) Judges in Ohio, Arizona, and Massachusetts were told they can serve as paid referees for football, soccer, and softball games.

D'Emic is pleased with the opinion. However, he isn't expecting his music career to significantly inflate his income.

"Now, I don't envision that it's gonna help much 'cause I do have a day job, and I can't really spend a lot of time trying to find jobs at night to play gigs at," D'Emic said. "But I would like to do it occasionally—less for the money, more for the fun."

For D'Emic, balancing responsibilities and playing in a band is just like old times. D'Emic first picked up a guitar when he was in high school. He played and sang in bands while he attended Fordham University and later Brooklyn Law School. He earned about $40 per show three times a week.

"I was able to pay my tuition," said D'Emic.

After graduating from law school, the future judge performed only occasionally—until recently. Shortly after the ethics committee's ruling, D'Emic attended a graduation party. There, he and a former Whippoorwill bandmate played songs by the Beatles and the Eagles. After their jam session, the pair called the third member of the band and decided to reunite.

Soon, the trio had a gig playing for a few dozen friends and relatives. D'Emic was visibly nervous at first. He watched closely as his fingers found the correct frets of his bass guitar as he sang. But he loosened up after a few songs. The set included Bob Dylan's "Mr. Tambourine Man," Van Morrison's "Brown-Eyed Girl," and Chuck Berry's "Johnny B. Goode." As the band played its final chord, the audience erupted into applause.

Paul Cassone plays lead guitar for the band. Cassone said he would like to see the trio play more frequently.

"It was like no time passed at all," said 56-year-old Cassone. "I feel like I'm 18 again."
