WarrantyAnother name for a guarantee
Express WarrantyOral or written statement, promise, or other representation about the quality, ability or performance of a product.
Full WarrantyPromises to fix or replace a defective product at no charge to the consumer.
Limited warrantyWritten warranty that does not meet the requirements of a full warranty. Examples - covers parts but not labor.
Implied WarrantyA guarantee of quality imposed by law. It is not in writing.
Warranty of FitnessThe seller warrants by implication that the goods will be fit for hte purpose for which they are to be used. The warranty exsists whether the seller is a merchant or a private party.
Privity of contractDetermines who can sue whom over a question of performance required by a contract.
Duty to notifyTo succeed in a claim for breach of warranty, the buyer must satisfy his or her duty to notify. This duty requires the buyer to notify the seller within a reasonable time after a defect is discovered.
