The most hotlt contested issue at the Consttutional Conventino was over how the states would be represented in the Congree
The delegates from Virginia, Pennsylvania, Massachusetts and North Carolina wanted the representation to be based on the states population.
The remaing states believed that the proposed Virginia plan was unfair and insdisted thast all of the states shodul be equally represented.
Roger Sherman of Connecticut offered a solution. He suggested a compromikse that would a create a bicameral legislature where there would be a House of Representatives based on population which gave the four largest states what they wanted, while creating a senate where each state would equal represented satisfied the small states.
This Great Compromise gave the small states a mechanism that enabled them prevent being totally dominted by t he large states
This important check and the balance of power was lost with the ratification of the 17th Smendment,
The bicameral legislature became a unicameral legislature with two Houses deprived the smaller states of their ability to block legislation that favored the large states.
To guarantee that the representation of the states in the senate could never be taken away, the framer's of the Constitution provided in Article V that no state shall ever be denied their suffrage in the senate without their consent,
Currently there are 47 states have given their consent by ratifying thr 17th Amendment and 7 states have never given their consent to surreder their right to be represented in the senate
The right of the states to be representde in the senate can not lawfully be taken away. The seven that not ratified the 17th Amendment are Florida, Georgia, Kentucky ,Mississippi,, North Carolina, Utah and Virginia.
Delaware initially rrejected the 17th Amendment on March18,1913 but on June 25 2010.thir legislature voted to changed their vote.
This action created a president that should allow states that initially ratified the Amendment to withdraw their vote to ratify the 17th Amendment
For the Amendment to stand it would need the ratification of 38 states, If six of the states that voted to reiify the amendment only 37 state's would have given their consent to give up their siffrage in the senate.
